The terms that apply when you engage ExplainerHK for design work, or simply browse our website—written in the same plain language we bring to every chart.
These Terms of Service govern your use of the ExplainerHK website and any design services you engage us to provide. By using this site or engaging our services, you agree to these Terms. Specific projects are also governed by the relevant signed proposal or agreement, which takes precedence over these Terms where the two conflict.
We provide design services including charts, infographics, presentations, and related work, with scope, deliverables, and timeline confirmed in writing before a project begins.
Fees are agreed in writing before work begins. Unless otherwise agreed, invoices are payable within 14 days of the invoice date, and we may pause work if payment is overdue.
Ownership of final deliverables transfers to you upon full payment; until then, all work remains our property. We may display completed, non-confidential work in our portfolio unless you request otherwise. Confidential or NDA-protected work is never displayed.
Our services are provided on an "as is" basis. To the extent permitted by law, our total liability arising from any project is limited to the amount paid for that project, and we are not liable for indirect or consequential losses.
These Terms are governed by the laws of Hong Kong SAR, and any disputes are subject to the exclusive jurisdiction of the Hong Kong courts.
